The DGFT vide Notification No. 39/2023 dated October 23, 2023, has made amendments to the Import Policy conditions of Human Embryos and Human Gametes classified under ITC (HS) 0511 99 99 of Chapter 05 of ITC(HS), 2022, Schedule –I (Import Policy). These amendments now categorize the import of Human Embryos and Human Gametes as ‘Prohibited,’ in accordance with the ART (Regulation) Act, 2021, and the Surrogacy (Regulation) Act, 2021.
In exercise of powers conferred by Section 3 and Section 5 of Foreign Trade (Development & Regulation) Act, 1992, read with paragraph 1.02 and 2.01 of the Foreign Trade Policy 2023, as amended from time to time, the Central Government hereby amends the policy conditions of item under Chapter 05 of ITC (HS), 2022, Schedule –I (Import Policy) as follows –
