The CBIC vide Notification No. 69/2019-Customs (N.T.) dated October 01, 2019 has introduced ‘The Manufacture and Other Operations in Warehouse (no. 2) Regulations, 2019’. This Regulation is applicable to units that undertakes manufacturing and other operations in relation to goods in a warehouse in terms of Section 65 of the Customs Act, 1962 (“the Act”) or to the units applying for permission to operate under section 65 of the Act.
Eligibility for application for operating under these regulations
The following persons shall be eligible to apply for operating under these regulations, –
- a person who has been granted a licence for a private warehouse
- a person who applies for a licence for a private warehouse, along with permission for undertaking manufacturing or other operations in the warehouse under section 65 of the Act.
Further, this Regulation provides for inter-alia:
- Manner of making Application
- Grant of permission
- Validity period of such permission
- Manner of appointment of warehouse keeper
- Conditions for transport of goods from the customs station of import to a warehouse or from one warehouse to another warehouse or from the warehouse to a customs station for export
- Manner of receipt of goods from customs station or from another warehouse or domestically procured goods
- Manner of transfer of goods from a warehouse
- Manner of removal of resultant goods for home consumption or for export
- Manner of maintenance of records in relation to warehoused goods
