A bench of Gujarat High Court judges H N Devani and S N Vishen rebuked the chief commissioner of State tax while rejecting an inquiry report over alleged atrocities committed by the officials of the department. The court has posted further hearing on December 11 after government pleader Manisha Shah prayed time to submit another report.
Earlier the bench had ordered Chief Commissioner of State Tax, Ahmedabad, to conduct an inquiry against GST officials for illegally camping at house of taxable persons without authority of law. The court was hearing a petition filed by Paresh Chauhan claiming GST officials forcefully camped inside his house from October 11 to 18. The GST officers were stationed in the flat round the clock and his family members were not allowed to leave the house.
“Government pleader has tendered a report of inquiry made by the Chief Commissioner of State Tax, Gujarat, in compliance with the directions issued by this court. Upon perusal of the report, it emerges that it is no better than the earlier report submitted by the Assistant Commissioner of State Tax and does not meet with the directions issued by this court in letter and spirit,” the bench observed.
